Important notice — read carefully. By accessing the website, uploading patient information or PET-CT images, making payment, creating a request, downloading a report, or otherwise using the Second Read Service, you confirm that you have read, understood and agreed to these Terms. If you do not agree, do not use the Service, upload data or make payment.
These Terms govern TPPL’s Second Read PET-CT Imaging Review Service. The Service is an imaging-review service only, intended to provide radiological observations on uploaded PET-CT and related imaging material for clinical correlation by your own treating physician.
1. Definitions and interpretation
- “TPPL” means Theranostic Physicians Private Limited, the Indian company operating this PET-CT Imaging Review Service.
- “Service” means the Second Read PET-CT Imaging Review Service, consisting only of preliminary radiological review and interpretation of uploaded imaging material.
- “You”, “User” or “Patient” means the individual patient or authorised representative using the Service or making payment.
- “Uploaded Materials” means PET-CT images, prior imaging, reports, medical records, clinical information and all other documents uploaded by you.
- “Report” means the preliminary radiological observations prepared by TPPL physicians based only on the Uploaded Materials.
- “TPPL Physicians” includes Dr. Ishita B. Sen, Dr. Dharmender Malik, qualified nuclear medicine physicians associated with TPPL and NMC-registered radiologists engaged for the Service.
- “Treating Physician” means your own qualified physician who has examined the patient, knows the clinical context and is responsible for diagnosis, clinical correlation and treatment decisions. TPPL Physicians are not Treating Physicians under this Service.
- “Personal Data” includes identity, contact, health, imaging and report data relating to an identifiable individual.
- “Protected Parties” means TPPL, TPPL Physicians, employees, contractors, agents, affiliates, directors, officers, shareholders, successors and assigns.
2. Critical clarification — nature of Service
2.1 Imaging review only — not medical advice or treatment
The Service consists only of preliminary radiological review and interpretation of PET-CT images and related uploaded material. TPPL Physicians document observations visible on the scans to the best of their professional understanding at the time of review.
The Service is limited to reviewing uploaded images, documenting visible imaging findings, descriptive radiological observations, and providing imaging inputs that require clinical correlation by a Treating Physician.
2.2 What the Service does not provide
The Service does not include medical diagnosis, treatment recommendations, clinical-management advice, second medical opinion on treatment strategy, physical examination, direct consultation, medication prescription, emergency care, ongoing monitoring, new diagnostic testing, clinical correlation with symptoms or labs, verification of uploaded records, guarantee of accuracy, confirmation/refutation of another diagnosis, or licensed medical practice in your country of residence.
2.3 Mandatory clinical correlation
All observations in the Report must be clinically correlated by a qualified Treating Physician. The Report has no standalone clinical meaning and must not be used as the sole basis for diagnosis, treatment, surgery, medication, emergency decision or self-treatment.
Your Treating Physician alone is responsible for determining the clinical relevance of imaging findings and making all medical decisions. TPPL and TPPL Physicians do not undertake clinical correlation and do not assume responsibility for decisions made by you, your Treating Physician or any third party.
2.4 Dependency on Uploaded Materials
The Report is entirely and exclusively based on the Uploaded Materials. TPPL does not independently verify whether the materials are authentic, complete, technically adequate, correctly labelled, attributable to the correct patient, unaltered, clinically sufficient, or produced by the correct diagnostic centre.
2.5 Deficient uploaded material
Incomplete, poor-quality, motion-degraded, altered, mislabeled, wrong-patient, wrong-body-part, missing-sequence, forged, inaccurate or clinically insufficient material can make the Report limited, inaccurate, incomplete or non-contributory. You are solely responsible for every uploaded file and document.
3. No doctor-patient relationship
Using the Service does not create a doctor-patient relationship between you or the patient and TPPL, TPPL Physicians or any Protected Party. The Service is not a clinical consultation, medical advice, diagnosis, treatment advice or continuing medical care.
TPPL Physicians act only as image reviewers. No physician-patient confidentiality, fiduciary duty, duty of care or treatment relationship arises beyond the limited obligation to provide the imaging review for the applicable Service fee.
All medical decisions — diagnosis, treatment selection, treatment modification, continuation, discontinuation and follow-up — must be made only by your Treating Physician after considering the complete medical history, examination, pathology, labs, imaging and clinical condition.
4. Proper use of the Imaging Review Report
4.1 Intended purpose
The Report is intended only to provide nuclear medicine radiological observations on PET-CT imaging and to document visible imaging findings from Uploaded Materials. It may be shared with your Treating Physician as an additional radiological input.
4.2 Strictly prohibited uses
You must not use the Report for standalone diagnosis, treatment decisions without a Treating Physician, emergency decisions, self-diagnosis, self-treatment, self-prescription, medico-legal or forensic use, insurance or legal disputes, litigation, disability claims, expert evidence, challenging another doctor, or replacing comprehensive clinical evaluation.
4.3 Critical medical disclaimer
The Report contains radiological observations only. It is not a diagnosis, not medical advice, not a treatment recommendation, not a comprehensive medical evaluation, and not emergency medical care. If symptoms are urgent or rapidly worsening, seek immediate in-person emergency care.
5. Absolute prohibition on medico-legal use
The Report is intended only for radiological review and clinical correlation in ongoing patient care. It must not be used, submitted, relied upon, cited or introduced in any legal, forensic, regulatory, insurance, administrative, judicial, quasi-judicial, arbitration, mediation, malpractice, negligence, licensing, workers’ compensation, personal injury, criminal or benefit-adjudication proceeding in any jurisdiction.
Neither TPPL nor any TPPL Physician will participate in or support such proceedings, provide testimony, act as an expert witness, cooperate in forensic evaluation, or provide legal medical opinion based on the Report. Any attempted medico-legal or forensic use is a material breach.
You agree to indemnify TPPL and all Protected Parties from claims, costs, damages, legal fees, losses or proceedings arising from any prohibited use of the Report.
6. Comprehensive limitation of liability and indemnification
6.1 Standard of care and inherent limitations
TPPL Physicians exercise reasonable professional care while reviewing images. However, imaging interpretation involves professional judgment; qualified physicians may differ; PET-CT has technical and clinical limits; false-positive and false-negative findings can occur; small lesions or certain disease patterns may not be visible; and imaging findings cannot be interpreted without clinical context.
6.2 Exclusion of liability
To the maximum extent permitted by law, TPPL and Protected Parties are not liable for direct, indirect, incidental, consequential, special, punitive or other damages; financial loss; medical expense; emotional distress; physical injury; loss of life; missed, delayed or incorrect diagnosis; clinical decisions by Treating Physicians; disease progression; adverse outcome; reliance on the Report; technical failures; delay; data breach; deficiencies in Uploaded Materials; or any cause connected with use of the Service or Report.
6.3 Maximum liability cap
If TPPL or any Protected Party is found liable despite the exclusions, the maximum aggregate liability is limited to the actual amount paid by you to TPPL for the specific Service instance giving rise to the claim.
6.4 Global scope
The limitations apply in every jurisdiction to the maximum extent permitted by law, regardless of legal theory, foreseeability or failure of any limited remedy.
6.5 Your indemnity
You agree to indemnify, defend and hold harmless TPPL and Protected Parties from all claims, proceedings, losses, liabilities, damages, costs and expenses arising from your use or misuse of the Service, reliance on the Report, breach of these Terms, violation of law, inaccurate uploaded information, wrong-patient material, prohibited legal use, third-party claims, failure to seek proper medical care, clinical decisions by you or others, or disputes with healthcare providers.
7. Fees, payment and strict no-refund policy
7.1 Payment requirement
Full payment must be made through TPPL’s designated payment gateway, currently Razorpay or another notified processor, before the request is queued. Payment constitutes acceptance of these Terms.
7.2 Timeline — best effort only
TPPL uses commercially reasonable efforts to deliver the Report within 72 hours after complete Uploaded Materials and successful payment confirmation are received. This is a best-effort target, not a guarantee, warranty or binding deadline.
7.3 Potential delays
Delays may occur due to incomplete material, poor-quality uploads, large files, upload/transmission issues, IT/payment problems, physician unavailability, emergencies, weekends, holidays, high demand, capacity limits, force majeure or other circumstances beyond reasonable control. TPPL is not liable for delay-related consequences.
7.4 Strict no-refund policy
All Service fees are strictly non-refundable. Once the case is assigned for physician review or the Report is generated and delivered, whichever happens first, the Service is treated as completed and no refund is provided for dissatisfaction, disagreement, conflicting opinions, change of mind, decision not to proceed, perceived errors, poor uploaded material, deterioration, financial hardship or any other reason.
7.5 Limited refund exceptions
A refund may be considered only at TPPL’s sole discretion for rare cases such as duplicate payment for the same case, complete TPPL-side technical failure preventing Report generation despite reasonable efforts, or payment received but no Uploaded Materials submitted within 30 days. Refund or grievance requests may be sent to secondread@nuclearmedicinetherapy.in.
7.6 Refund process and deductions
If approved, refunds are normally processed to the original payment source and may be reduced by gateway charges, refund-processing charges, currency-conversion fees, bank/wire fees, administrative fees and other applicable costs. Currency fluctuations are your responsibility. Bank/payment-provider processing may take 7–14 business days or longer.
7A. Links to other websites
The Service may include third-party links or services not owned or controlled by TPPL. TPPL is not responsible for their content, policies, practices, goods or services. Review third-party terms and privacy policies before use.
8. Data privacy, security, retention and deletion
8.1 Privacy commitment
TPPL aims to protect patient data under applicable laws including the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, GDPR for EU users where applicable, and other relevant privacy regulations.
8.2 Consent to processing
By using the Service, you consent to collection, storage, processing, use, retention and cross-border transfer of Personal Data for report generation, case communication, billing, payment processing, records, quality assurance, audit, peer review, service improvement, legal compliance, anonymized research and defence of legal claims.
You understand that health data is sensitive personal data, may be processed in India, and may be subject to a different regulatory framework than your country. You may withdraw consent by contacting secondread@nuclearmedicinetherapy.in, without affecting lawful processing already completed.
8.3 Retention period — 14 days
Patient Personal Data, Uploaded Materials and Reports are retained on TPPL’s active primary operational systems for a maximum of 14 calendar days from Report delivery to address queries or clarifications, subject to legal, audit, regulatory, tax or compliance requirements requiring longer retention.
8.4 Deletion from primary systems
After 14 days, TPPL initiates deletion or irreversible anonymization from primary operational systems, subject to legal, regulatory, tax, audit, dispute, investigation or legitimate business-record requirements.
8.5 Cloud and backup limitations
TPPL may use third-party cloud, hosting, backup and IT infrastructure providers including AWS, Google Cloud, Microsoft Azure, Dropbox or similar services. Residual data may continue in backups, logs, snapshots, caches, archives or disaster recovery systems. Complete deletion from every third-party backup system cannot be guaranteed within 14 days.
8.6 Consent to cloud limitations
By using the Service, you consent to cloud-based storage and accept that deletion timing, completeness and permanence from third-party systems may not be fully within TPPL’s control.
8.7 No liability for third-party retention
TPPL and Protected Parties are not liable for continued storage or existence of Personal Data in third-party cloud systems, backups or archives after the 14-day active-system retention period.
9. Representations, warranties and covenants by you
By using the Service, you represent and warrant that you are the patient or legally authorised representative; you have all required consents; the patient is aware of and consents to the Service; all uploaded material is accurate, complete, authentic and not misleading; the material belongs to the correct patient; you have the right to upload/share it; it does not infringe third-party rights; you are at least 18 or the age of majority; your use is lawful; you understand this is imaging review only; you will use the Report only for clinical correlation; and you will not use it for legal, forensic or medico-legal purposes.
9.1 “As is” and “as available” disclaimer
The Service is provided “as is”, “as available” and with all faults. TPPL and Protected Parties disclaim all warranties including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free service, reliability, currentness, virus-free transmission or correction of defects.
9.2 Liability for breach
You are solely responsible for any breach of your representations and agree to indemnify TPPL and Protected Parties for claims, damages or losses resulting from such breach.
10. Governing law, jurisdiction and dispute resolution
These Terms and all disputes relating to the Service, Report or Uploaded Materials are governed by the laws of India. You submit to the exclusive jurisdiction of courts in Delhi / New Delhi, India, regardless of where you or the patient are located or where treatment occurs.
You waive objections to jurisdiction or venue, waive claims that Delhi/New Delhi is an inconvenient forum, waive the right to bring proceedings elsewhere, consent to personal jurisdiction in Delhi/New Delhi courts, waive trial by jury to the extent permitted by law, and waive participation in class, collective, representative or consolidated actions against TPPL or Protected Parties.
11. General provisions
- Entire agreement: these Terms are the complete agreement for the Service.
- Amendments: TPPL may update these Terms at any time; continued use means acceptance.
- Severability: invalid provisions are modified or severed only as required; the rest remains effective.
- No waiver: failure to enforce a right is not a waiver; waivers must be written.
- Assignment: you may not assign obligations without TPPL consent; TPPL may assign or transfer rights and obligations.
- Force majeure: TPPL is not liable for delay or failure due to events beyond reasonable control including disasters, public-health events, war, terrorism, civil unrest, strikes, government action, telecom failures or power outages.
- Survival: scope, disclaimers, privacy, indemnity, liability, jurisdiction and acceptance provisions survive completion or termination.
- Interpretation: headings are for convenience only; singular includes plural; “including” means including without limitation.
12. Termination
TPPL may terminate or suspend access immediately, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately, but surviving obligations continue.
13. Binding acceptance of Terms
By accessing the website, registering, uploading patient data or images, making payment, downloading or using the Report, you confirm that you have read and accepted these Terms; understand the Service is imaging review only; accept that no doctor-patient relationship is created; accept the liability limits and indemnity obligations; consent to data processing, cloud-storage limits and 14-day active-system retention; accept the strict no-refund policy; understand the Report depends entirely on Uploaded Materials; consent to Indian law and Delhi/New Delhi jurisdiction; and agree not to use the Report for medico-legal, forensic or legal purposes.
If you do not agree to these Terms in full, do not use the Service, upload materials or make payment.
